On February 2, 2014, four drivers/driver’s helpers of JP Mascaro filed a federal lawsuit in the United States Courthouse for the Eastern District of Pennsylvania, asserting that JP Mascaro failed to pay them and hundreds of other Drivers and Driver’s Helpers overtime wages as required under the Fair Labor Standards Act. Additionally, the four Plaintiffs who were employed by JP Mascaro in Pennsylvania, have also asserted that JP Mascaro’s pay policies are in violation of the Pennsylvania Minimum Wage Act and Pennsylvania Wage Payment and Collection Law. The four Plaintiffs assert that JP Mascaro failed to pay them and other Drivers and Driver’s Helpers overtime wages for hours worked in excess of 40 hour in a workweek. The Plaintiffs also assert that JP Mascaro failed to pay its driver’s helpers the minimum wage for all hours worked.
