Are you working off-the-clock? Many wage and hour violations occur because employers fail to pay their employees for all hours worked.  Work, as it is defined under the FLSA, does not necessarily require exertion or effort.  Rather, any task which is is “integral” and “indispensable” to the job counts as hours worked, and MUST be paid.  For example, if you are required to attend pre-shift meetings, you must be paid for the entire meeting.  If you are required to put on safety equipment at work, you generally must be paid for such time.  If you are required to prepare equipment, turn on machines, or boot up your computer, all of this time must be paid.  If you believe you are being forced to work without compensation, please call us today.

Are you being paid true time-and-one half for overtime?  As it turns out, many employees believe they are receiving full overtime benefits, even though they are not.  For example, did you know that the Fair Labor Standard Act requires that time-and-one half include commission payments, shift differentials, and non-discretionary bonuses?  Moreover, just because you are salaried does not mean that you are not entitled to overtime compensation.
