In New Jersey, eligible employees are protected by the federal Fair Labor Standards Act and the New Jersey State Wage and Hour Law. Under the FLSA, statutory non-exempt employees must be paid a minimum wage of $7.25 per hour. In New Jersey, however, the minimum wage is set at $8.44 per hour under the state’s law. This means that workers in New Jersey are entitled to be paid the state’s minimum wage rather than the federal minimum.

There are also specific rules if you earn a tipped wage. If you receive a tipped wage, you must receive the equivalent of $8.44 per hour when your wages are combined with the tips that you receive. Non-exempt employees are also entitled to receive overtime compensation that is equal to one-and-one-half times their hourly pay for all hours that they work above 40 in a week.
