Non-exempt workers in Ocean City, New Jersey must receive at least the minimum wage for each hour worked. When a non-exempt worker works more than 40 hours during any workweek, he or she must also receive overtime compensation at a rate of 1.5 times his or her regular hourly rate. These rights are protected under the federal Fair Labor Standards Act and New Jersey’s state laws. The FLSA establishes the federal minimum wage and overtime pay requirements for non-exempt workers. Under this law, employers in every state must pay their non-exempt employees a minimum of $7.25 per hour. This means that you must be paid at least $12 per hour if you are employed as a non-exempt worker in New Jersey.

Non-exempt workers who work overtime hours must also receive an overtime premium on top of their regular rates of pay. This premium is equal to one-half of their regular rates. If you work more than 40 hours during a week and are a non-exempt worker, you must be paid overtime pay.

Despite these laws, some employers attempt to avoid them by engaging in unlawful practices. For example, an employer might try to misclassify you as an independent contractor or exempt employee to avoid paying you the minimum wage or overtime pay.
