The United Services Employment and Reemployment Act (“USERRA”) provides job protection to our well-deserving veterans who are required to miss work due to military service or who are are discriminated against by their employer by virtue of their military service. Right to Reemployment and Military Leave
USERRA provides protection from unlawful discharge and discrimination to members of the armed service who are required to take a a leave of absence from their employment to perform military service.
To gain protection under USERRA, you must notify provide advance notice to your employer – in writing or verbally – that you require a leave of absence to perform military service. Once notified, your employer must provide you protected leave. Upon return from military service, your employer must return you to work and provide you the same job (or a substantially similar one) with the same benefits that you had prior to your leave. Your employer may not terminate you, demote you, or substantially change your job duties because you required a leave for military service.

You also have the right to elect to continue your existing employer based health plan for you and your family for up to 24 months while you are on military leave. Even if you opt not to continue with such coverage, your employer must reinstate your health coverage upon your return from military service without any waiting periods of exclusions.
Right to be Free From Discrimination
USERRA also provides past and present members of the Armed Services protections from discrimination in employment. An employer may not take any adverse employment action based on military status. Specifically, an employer may not fire, demote, or harass you because of your military status. An employer may also not deny you initial employment, deny a promotion to you, or deny you any other benefit of employment because of your military service.
