On February 3, 2011, a former Gerdau Ameristeel employee filed a lawsuit in federal court seeking class action status relating to allegations that Gerdau Ameristeel forced its employees to work off-the-clock. Since then, more than 800 current and former employees have filed documents with the Court seeking to join the lawsuit.
Specifically, the lawsuit alleges that hourly employees of Gerdau Ameristeel were forced to report to work prior to the start of their shift and were forced to start the workday prior to clocking in to work, and were further not permitted to leave at the time they clocked out. The lawsuit asserts that employees were forced to arrive early to place their safety gear on. Further, it is asserted that the employees were forced to walk substantial distances after putting on safety equipment before arriving to the time clock where they clocked in. Similarly, at the end of the day, the lawsuit asserts that employees were forced to clock out before proceeding to the locker room to remove their safety equipment. The employees were thus, “off the clock” for all time spent walking to and from the locker room, and for all the time they spent taking on and removing their safety equipment.
