Private: Arizona DNC FLSA Collective and Class Action

United States District Court for the District of Arizona
Docket No.: 2:18-cv-00321

Counsel: Joshua Boyette, Justin Swidler

On January 30, 2018, three over-the-road truck drivers of P.A.M. Transportation Services, Inc. (“PAM”) filed a federal lawsuit in the United States District Court for the Western District of Arkansas asserting that PAM violated the Fair Labor Standards Act (“FLSA”) and the Arkansas Minimum Wage Law. The Complaint alleges that PAM failed to pay its drivers minimum wage as required by federal and state law.

On May 8, 2017, the Court conditionally certified the case as a collective action under the FLSA for “all over-the-road drivers who were employed by Defendant P.A.M. Transport, Inc. at any point from May 5, 2014 through May 5, 2017.” As a result of the certification, any individual who worked for P.A.M. Transport as an over-the-road truck driver from May 5, 2014 through May 5, 2017 may join the lawsuit by submitting a consent form below. Only those individuals who submit consent forms will be eligible to receive compensation in the event that Plaintiffs recover compensation on their FLSA claims.
