On April 27, 2021, 2020, Lafondra Butts, a former Yard Driver at Boone Logistics Services, LLC, filed a federal lawsuit in the United States District Court for the District of Delaware, asserting that Boone Logistics failed to pay him and other employees overtime wages as required under the Fair Labor Standards Act. Specifically, the Mr. Butts alleges that Boone Logistics misclassified him and other Yard Drivers as exempt from overtime wages and failed to pay them an additional 50% of their regular rates for working more than 40 hours in a week.
If you have worked in for Boone Logistics as a Yard Driver at any time since May 2018, you may be eligible to join the FLSA lawsuit. The Court has not yet made any determinations regarding the merits of the case or whether the case will be certified as a collective action. However, the statute of limitations (i.e. the amount of time that may pass prior to you being unable to sue Boone Logistics because too much time has passed) will continue to run until you file a Consent Form (provided below) with the Court in this case or file your own case. It may be entitled to receive attorney’s fees and costs from Boone Logistics should there be a recovery or judgment in favor of the Plaintiffs. If there is a recovery, Swartz Swidler, LLC will receive a part of any settlement obtained or money judgment entered in favor of all members of the class or their fees will be paid separately by Boone Logistics.
