On April 10, 2017, a former J & D Transportation driver filed a federal lawsuit in the United States Courthouse for the District of New Jersey, asserting that J & D Transportation failed to pay him and other J & D Transportation drivers overtime and minimum wages as required under the Fair Labor Standards Act. The Named Plaintiff, Bobby Thomas, asserts that J & D Transportation failed to pay him and other employees overtime wages by unlawfully deducting for breaks that they were not actually able to take or which should not have been classified as non-compensable.

On August 13, 2018, the United States District Court for the District of New Jersey granted Plaintiff’s request and conditionally certified this matter as a collective action pursuant to the Fair Labor Standards Act (a federal law requiring that employees receive certain wages, such as proper overtime for all overtime hours worked). Because of the ruling, all drivers of J & D Transportation will receive notice of the litigation and will be given an opportunity to join the case.
