On December 9, 2016, three over-the-road truck drivers of P.A.M. Transportation Services, Inc. (“PAM”) filed a federal lawsuit in the United States District Court for the Western District of Arkansas asserting that PAM violated the Fair Labor Standards Act (“FLSA”) and the Arkansas Minimum Wage Law. The Complaint alleges that PAM failed to pay its drivers minimum wage as required by federal and state law.

On January 25, 2019, the Court certified the matter as a class action under state law and determined that the case should continue  as a collective action under federal law.

On February 18, 2020, the Court granted Preliminary Approval of a Class-wide settlement.  Pursuant to the Agreement, PAM will pay $16.5 million to settle the lawsuit.  The full settlement agreement is provided below.
