On Friday, December 20, 2013, plaintiffs filed a motion for preliminary approval of a settlement in the amount of $6,000,000 (six million dollars) to resolve the claims asserted in the Keller et al. v. TD Bank lawsuit. We believe the settlement reached, after more than 1 year of litigation, fairly compensates the Class Members and is the best interests of the class. If you received a notice of the class action settlement in the mail and are an eligible class member, you may obtain more information regarding the settlement and the claims being asserted in this action by contacting Justin Swidler or Richard Swartz. Additionally, you may review the documents which have been filed with the Court.
In April of 2014, the Court preliminarily approved the proposed settlement and directed the Parties to send notice and claims forms to all eligible class members. You may obtain copies of the notice and claims forms by contacting the Claims Administrator at Keller v. TD Bank, c/o Heffler Claims Group, P.O. Box 58070, Philadelphia, PA 19102, 1-844-528-0189.
Additionally, copies of the Notice and Class Action Settlement and attached claim forms are available below. There are four Subclasses for purposes of settlement. The following are Notices of Class Action Settlement for each of the Subclasses. The state you worked in and your dates of employment determines your subclass.
Notice and Claims Form for Settlement Class 1: Delaware and Rhode Island TD Bank Employees who were employed at any point from June 26, 2010 through October 16, 2012.
Notice and Claims Form for Settlement Class 2: Connecticut, Florida, North Carolina, New Jersey, Virginia, and Vermont TD Bank Employees who were employed at any point from June 26, 2010 through October 16, 2012.
Notice and Claims Form for Settlement Class 3: District of Columbia, New Hampshire, Massachusetts, Maryland, South Carolina, New York, Pennsylvania, and Maine TD Bank Employees who were employed at any point from June 26, 2010 through October 16, 2012.
Notice and Claims Form for Settlement Class 4: Commerce Bank Retail Store/Branch Locations in New York, which Became TD Bank Retail Store/Branch Locations on or after March 31, 2008,at any point from June 26, 2007 through October 16, 2012.
