On May 15, 2015, David Atis, a mortgage loan professional of Freedom Mortgage Corp. filed a federal lawsuit in United States District Court for the District of New Jersey asserting that Freedom Mortgage Corp. violated the Fair Labor Standards Act (“FLSA”), and the New Jersey Law Against Discrimination by failing to pay all overtime wages due. Specifically, the lawsuit asserts that Freedom Mortgage unlawfully misclassified mortgage loan professionals titled Assistant Vice Presidents of Sales (AVPs) as exempt from overtime, and did not pay them overtime wages for hours worked in excess of 40 in a workweek.

On December 27, 2016, the United States District Court for the District of New Jersey granted Plaintiffs’ request and conditionally certified this matter as a collective action pursuant to the Fair Labor Standards Act (a federal law requiring that employees receive certain wages, such as proper overtime for all overtime hours worked). As a result of the ruling, all AVPs in the United States will receive notice of the litigation and will be given an opportunity to join the case.
